To create favorable conditions for individual investors with direct capital investment or representatives of foreign organizations investing in Vietnam to live and work in Vietnam, the Government has adopted flexible policies suitable for each type of investor granting temporary residence cards. In this article, OTIS LAWYERS would like to advise investors on the legal provisions related to issuing temporary residence cards to foreign investors in Vietnam.
Legal basis for granting temporary residence cards to foreign investors
Currently, the issuance of temporary residence cards to foreign investors is regulated in the Law on entry, exit, transit, and residence of foreigners in Vietnam (Law No. 47/2014/QH13, dated June 16, 2014). ) revised and supplemented in 2019 and related guiding documents.
Symbols and duration of temporary residence cards in each case of foreign investors
Stamp of temporary residence card "ĐT": issued to foreign investors in Vietnam. Which is divided into 04 types of temporary residence cards for foreign investors according to the investment capital in Vietnam as follows:
- ĐT1 – Term not exceeding five years - Issued to foreign investors in Vietnam and representatives of foreign organizations investing in Vietnam with a contributed capital of VND 100 billion or more or investing in sectors and trades eligible for investment incentives and geographical areas eligible for investment incentives shall be decided by the Government.
- ĐT2 – Term not exceeding five years - Granted to foreign investors in Vietnam and representatives of foreign organizations investing in Vietnam with a contributed capital of between VND 50 billion and under VND 100 billion or investment in industries and professions that encourage development investment are decided by the Government.
- ĐT3 – Term not exceeding three years - Granted to foreign investors in Vietnam and representatives of foreign organizations investing in Vietnam with capital contribution from 03 billion VND to less than 50 billion VND.
- ĐT4 – Term not exceeding 12 months - Issued to foreign investors in Vietnam and representatives of foreign organizations investing in Vietnam with a contributed capital of less than VND 03 billion.
Note: This case is only issued with a ĐT4 visa, not a temporary residence card.
Conditions for granting temporary residence cards to foreign investors
- The validity of a foreigner's passport must be more than 01 years;
- Are using the entry visa for the proper purpose;
- Papers prove the capital contribution or capital investment in the company in Vietnam (Depending on the specific case, it can be a confirmation of the bank related to the capital contribution or the transfer contract, the certificate of banks related to capital transfer).
Order and procedures for applying for a temporary residence card for foreign investors
Step 1: Prepare all required documents
Profile includes:
- Application form for a temporary residence card (Form NA8)
- Certified copy of Business Registration Certificate, Investment Registration Certificate
- Registration form of seal and signature of the company (Form NA16)
- Application for temporary residence card for foreigners (Form NA6)
- Documents proving the capital contribution or capital investment in the company in Vietnam
- Original passport;
- 02 white background color photos with size 2cm x 3cm.
- Certificate related to temporary residence registration.
Step 2: Apply with the fee for a temporary residence card at
- Administration of Immigration:
Head office: 44-46 Tran Phu, Ba Dinh, Hanoi.
Office in City. HCM: 254 Nguyen Trai, District 1, Ho Chi Minh City.
Office in Da Nang: 7 Tran Quy Cap, Da Nang City
- Or the Immigration Department of the provincial police and centrally-run cities.
Step 3: Get the results according to the appointment card
According to regulations, it is five working days from the date of submission of the application.
