According to Clause 14, Article 3 of the 2014 Law on Marriage and Family, divorce is the termination of the marital relationship pursuant to an effective judgment or decision of a Court.
There are currently two forms of divorce in Vietnam: unilateral divorce and mutual consent divorce.

Unilateral divorce (divorce at the request of one spouse) occurs when either the husband or the wife requests the Court to terminate the marriage because the marital relationship has severely deteriorated, cohabitation cannot continue, and the marital purpose can no longer be achieved.

Mutual consent divorce occurs when both spouses voluntarily agree to divorce and have reached an agreement on matters such as property division and child custody.

Fast Divorce Procedure: Step-by-Step Guide

Documents Needed for a Divorce Case

In general, the documents required for either unilateral or mutual consent divorce are similar. Common documents include:

  • Divorce petition:
    • For unilateral divorce: Use the Petition for Initiating Legal Action (Re: Divorce);
    • For mutual consent divorce: Use the Mutual Consent Divorce Request Form.
  • Marriage Certificate (original): If the certificate is lost, you may request a certified copy from the civil registry authority where the marriage was registered.
  • ID/ Citizen Identification Cards of both spouses (certified copies): If unavailable, the Court may accept alternative identity documents depending on its guidance.
  • Birth certificates of children (if any, certified copies);
  • Documents proving ownership of joint property (if any, certified copies).

Unilateral Divorce Procedure

Step 1: File the petition.
The spouse requesting the divorce must prepare and submit the complete dossier, documents, and evidence (if any) to the competent People’s Court.

Step 2: Mediation.
After receiving the petition, the Court will determine whether to accept and process the case. If the Court finds grounds to handle the unilateral divorce request, it will require the petitioner to pay the provisional court fee and proceed with mediation.

  • If mediation succeeds, the Court will issue a decision recognizing the agreement;
  • If mediation fails, the Court will bring the case to trial.

Step 3: First-instance trial.
After the trial, the Court issues a judgment officially terminating the marriage.

Mutual Consent Divorce Procedure

Step 1: Case acceptance.
Both spouses prepare the complete application and submit it to the competent People’s Court.

Step 2: Review of the request & public meeting.
The Court reviews the mutual consent petition, considers the grounds for terminating the marriage, and notifies the spouses to pay the provisional fee.
After payment, the Court will hold a public meeting to consider and resolve the request.

Step 3: Issuance of decision.
If mediation does not succeed, the Court issues a decision recognizing the mutual consent divorce.
Conversely, if mediation succeeds, the Court terminates the civil case.
