What is Vietnam visa expiration?
A Vietnam visa is issued by the Vietnam Immigration Department to foreigners to enter and stay short-term in Vietnam for legal purposes such as tourism, visiting relatives, working, investment, study abroad, work... On each visa issued to foreigners, the validity period of the visa is printed specifically.
Vietnam visa expiration is the act of a foreigner staying beyond the time limit printed on the issued Vietnam visa and still not having submitted an application to extend the stay period or not yet excited Vietnam. This is considered an illegal stay and will be subject to administrative penalties according to the Immigration Law.
Validity period of Vietnam visa
Depending on the type, the validity period of a Vietnam entry visa will be different. Below are the deadlines for some popular types of Vietnam visas today:
- LS Visa – Valid for a maximum of 1 year (12 months) or a maximum of 2 years in case of applying for a temporary residence card. Issued to foreign lawyers practicing in Vietnam.
- DL Visa – Maximum duration is 3 months (90 days) but only temporary residence is allowed for a maximum of 1 month (30 days) for tourists coming to Vietnam.
- DT visa - (Divided into DT1, DT2, DT3, DT4) Has a maximum term of 1 year (12 months) and is issued to foreign investors in Vietnam and representatives of foreign organizations investing in Vietnam.
- DN visa – (Divided into DN1, DN2) Normally it is 3 months (90 days). Issued to foreigners who work with businesses and other organizations with legal status according to the provisions of Vietnamese law. Foreigners offer services and carry out activities according to international treaties to which Vietnam is a member.
- LĐ visa - (Including LĐ1, LĐ2) Has a maximum term of 1 year (24 months) or 2 years for temporary residence card applications. Issued to foreigners working in Vietnam with a work permit, or confirmation that they are not subject to a work permit.
- EV Visa – This type of electronic visa is valid for 1 month (30 days)
- SQ visa: If a foreigner is eligible to apply for an SQ visa, the visa period is no more than 30 days.
- HN, DL visa: With this type of visa, foreigners have a period of no more than 03 months to stay, enter and exit Vietnam.
- VR Visa: Foreigners entering Vietnam for personal reasons should apply for this type of visa, which will be valid for no more than 6 months.
- Visa NG1, NG2, NG3, NG4, LV1, LV2, DN, NN1, NN2, NN3, DH, PV1, PV2 and TT: valid for no more than 12 months or apply for a temporary residence card with a longer term.
What are the penalties for overstaying a Vietnam visa?
When foreigners overstay their Vietnam visa, they will be considered as illegal residents and fined according to the law.
Pursuant to Article 18, Decree 144/2021/ND-CP issued by the Government, effective from January 1, 2022, the penalty for overstaying a visa depends on the overstay period of the foreigner. Specifically:
- Late less than 16 days: fine from 500,000 to 2,000,000 VND
- Late from 16 to 29 days: fine from 3,000,000 to 5,000,000 VND
- Late from 30 to 59 days: fine from 5,000,000 to 10,000,000 VND
- Late from 60 to 89 days: fine from 10,000,000 to 15,000,000 VND
- Late 90 days or more: fine from 15,000,000 to 20,000,000 VND
In addition to paying administrative fines for visa overstay. Foreigners will leave the country if they no longer want to stay in Vietnam. Besides, depending on the severity of the violation, whether it is minor or serious, it is possible to apply for an extension of the stay in Vietnam for a short time. If the violation is serious, the foreigner will be deported back to the country, even banned from re-entering Vietnam for a definite or permanent time.
What should foreigners do when their Vietnamese visa expires?
If you want to stay longer than the allowed visa period, you need to apply for a visa extension or a temporary residence card.
However, it is possible that for some reason, a foreigner who has expired his Vietnam visa but has not yet performed one of the above two procedures can reduce the settlement by two options: extending the visa or exiting the country. Return to Vietnam with a new visa.
Specifically how to do it as follows:
- Vietnam visa extension
When foreigners want to continue to stay in Vietnam for a short time and do not need to leave the country, they can do this procedure.
To be able to extend an overdue Vietnam visa, foreigners need to meet the following 4 prerequisites:
- Passport valid for at least 1 month longer than visa validity
- There is a legal guarantee by a company or individual in Vietnam
- Must declare temporary residence
- Overdue fines have been paid.
Procedures for visa extension are as follows:

- Form NA5 visa extension application
- Original passport with Vietnam visa sticker
- Copy of temporary residence declaration
- Other documents depending on each type of visa: Work permit/ Investment certificate/ Family relationship certificate: Certified copy.
- Some other forms: Letter of introduction, application explaining the reason for extension
Submit your application to one of the following two agencies:
- Immigration Department of provinces and cities
- Vietnam Immigration Department
- Headquarter in Hanoi: 44-46 Tran Phu Street, Ba Dinh District, Hanoi
- Representative office in the city. Ho Chi Minh: 333-335-337 Nguyen Trai Street, District 1, City. Ho Chi Minh
Processing time is about 5 - 7 working days.
- Exit Vietnam then enter with a new visa
Foreigners bring their passports to the Immigration Department. Here you will be instructed to pay overdue fines and complete procedures to exit Vietnam.
After exiting the country, if you want to return to Vietnam, you must apply for a new visa (in case the foreigner is not blacklisted).
